Our Commitment
Bath Fitter Distributing Inc. (“Bath Fitter”) is committed to ensuring that persons with disabilities have an equal opportunity to use and benefit from our goods, services and facilities. This includes ensuring that we provide our goods and services to people with disabilities in a manner that respects their dignity and independence. Consistent with our dedication to providing goods and services in accordance with the spirit and intent of the Accessibility for Ontarians with Disabilities Act (“AODA”), this Policy sets out our practices with respect to accessible customer service, design of public spaces and accessible information and communications.
Bath Fitter also has a Multi-Year Accessibility Plan that outlines the steps we have taken to meet out obligations under the AODA.
Definitions
For the purpose of this Policy:
“Disability” means:
• Any degree of physical disability, infirmity, malformation or disfigurement that is caused by bodily injury, birth defect or illness and, without limiting the generality of the foregoing, includes diabetes mellitus, epilepsy, a brain injury, any degree of paralysis, amputation, lack of physical co-ordination, blindness or visual impediment, deafness or hearing impediment, muteness or speech impediment, or physical reliance on a guide dog or other animal or on a wheelchair or other remedial appliance or device,
• A condition of mental impairment or a developmental disability;
• A learning disability, or a dysfunction in one or more of the processes involved in understanding or using symbols or spoken language;
• A mental disorder; or
• An injury or disability for which benefits were claimed or received under the insurance plan established under the Workplace Safety and Insurance Act (Ontario).
“Service animal” means an animal accompanying a person with disabilities if it is readily apparent that the animal is used by the person for reasons relating to their disability, or, if the person provides a letter from a physician or nurse confirming that they require the animal for reasons relating to the disability. This definition includes guide dogs used by the blind or visually impaired.
“Support person” means a person who accompanies a person with a disability in order to help with communication, mobility, personal care or medical needs or with access to goods or services. The support person could be a paid personal support worker, a volunteer, a friend or a family member. They do not necessarily need to have special training or qualifications.
CUSTOMER SERVICE
1. Accessible Communication Supports
Bath Fitter and its employees will communicate with people with disabilities in ways that take into account each person’s particular disability.
2. Service Animals and Support Persons
Unless otherwise prohibited by law, persons with disabilities will be permitted to be accompanied by a service animal or support person: (i) where services are provided at premises owned or operated by Bath Fitter; and (ii) where the public or third parties normally have access to such premises.
3. Assistive Devices
Bath Fitter is committed to serving people with disabilities who use assistive devices. Bath Fitter endeavors to become familiar with the various assistive devices used by people with disabilities and will be flexible in facilitating their use by people with disabilities to access our goods and services.
4. Disruption in Service
Bath Fitter will post timely public notice of a current or anticipated disruption in any facilities or services that Bath Fitter provides to enable people with disabilities to access our services. This notice will include information about the reason for the disruption, its anticipated duration, and a description of alternative facilities or services, if available.
5. Training
Bath Fitter provides training appropriate to the duties of their employees, volunteers, or other person acting on behalf of Bath Fitter (referred to below as “workers”).
Specifically, workers who may reasonably be expected to interact with the public or third parties on behalf of Bath Fitter, and workers who are involved in the development, approval, monitoring or implementation of Bath Fitter’s customer service policies, practices and procedures about the provision of goods and services to the public and/or third parties, receive training on:
• The purposes of the AODA and the requirements of its Customer Service Standard.
• How to identity, prevent and remove barriers to accessible communication.
• How to provide information through a communication support or accessible format.
• Bath Fitter’s policies, practices and procedures with respect to accessibility and any changes to same.
• The provisions the Ontario Human Rights Code pertaining to disability.
• How to interact and communicate with persons with various types of disability.
• How to interact with persons with disabilities who use an assistive device or require the assistance of a guide dog or other service animal or the assistance of a support person.
• How to use equipment or devices available on Bath Fitter’s premises or otherwise provided by Bath Fitter that may help with the provision of goods or services to a person with a disability.
• What to do if a person with a particular type of disability is having difficulty accessing the provider’s goods or services.
Revised training will be provided in the event of changes to legislation, procedures and/or practices.
Bath Fitter maintains a record of training provided, including the dates on which training was provided and the number of individuals who received it.
DESIGN OF PUBLIC SPACES
In the event that Bath Fitter builds off-street parking facilities or is constructing new service counters, waiting areas, or queuing guides, such space shall be designed and built in accordance with all accessibility requirements of the AODA and applicable building legislation.
INFORMATION AND COMMUNICATION
6. Accessible Formats and Communication Supports
Upon request and where necessary, Bath Fitter will provide or arrange for the provision of accessible formats and communication supports for persons with disabilities in a timely manner, that will take into account the person’s accessibility needs due to the disability. Bath Fitter will consult with the person making the request in determining the suitability of an accessible format or communication support.
7. Web Content
Our internet websites and web content conform with the World Wide Web Consortium Web Content Accessibility Guidelines (WCAG) 2.0, Level AA.
8. Emergency Procedures
In the event that we make public safety information available to the public, we will provide it in an accessible format or with appropriate communication supports as soon as practicable upon request.
9. Feedback Process
Bath Fitter welcomes feedback regarding the methods we use to provide services to persons with disabilities. Customer feedback is encouraged to continue identifying barriers, and to ensure accessibility is always readily available.

Bath Fitter will review and assess all feedback and any complaints received with respect to our accessibility practices and policies. Customers can expect to hear back in a timely manner depending on the complexity of the issues raised.
Bath Fitter ensures our feedback process is accessible to people with disabilities through the provision or arrangement of accessible formats and communication supports, upon request.
We may also receive Technical Data about you if you visit other websites employing our cookies. We also have third parties that collect personal information this way, or our vendors, use several common online tracking tools to collect this information.
Controlling Our Tracking Tools
Your browser may give you the ability to control cookies, and browser add-ons like Ghostery allow you to decide which cookies to activate/deactivate. How you do so depends on the type of cookie. Why? Because flash cookies cannot be controlled through your browser settings. Your device may not give you the ability to control cookies. If you configure your computer to block cookies, you will limit the functionality we can provide when you visit our Website. If you configure to block or delete cookies, not all of the tracking that we have described in this General Privacy Policy will stop.
Some browsers have a “Do Not Track” feature that lets you inform Website that you do not want to have your online activities tracked. These browser features are not uniform, so we are not currently set up to respond to those signals.
Controlling Online Interest-Based Ads
We sometimes work with online advertising vendors to provide you with relevant and useful ads. This may include ads served on our Website or device applications. This may also include ads served on other websites. These ads may be based on information collected by us or third parties. For example, information a third party collects when you register on a website: e.g. your zip code. This might be used to target an ad for people in your area. These ads may also be based on your activities on our Website or on third-party websites.

Privacy Notice for California Residents According to the CCPA
This Privacy Notice for California Residents applies solely to all visitors, users, and others who reside in the State of California (“consumers” or “you”). We have adopted this notice to comply with the California Consumer Privacy Act of 2018 (“CCPA”) and any terms defined in the CCPA have the same meaning when used in this Section of the General Privacy Policy.
Information We Collect
We collect information that identifies, relates to, describes, references, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer, household, or device (“Personal Information”). Personal Information does not include:

You have the right to request that we disclose certain information to you about our collection and use of your Personal Information over the past 12 months. Once we receive and confirm your verifiable consumer request, we will disclose to you:

Deletion Request Rights

Once we receive and confirm your verifiable consumer request, we will delete (and direct our Service Providers to delete) your Personal Information from our records, unless an exception applies.
We may deny your deletion request if retaining the information is necessary for us or our Service Provider(s) to:
· Complete the transaction for which we collected the Personal Information, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, fulfill the terms of a written warranty or product recall conducted in accordance with federal law, or otherwise perform our contract with you;

· Exercise free speech, ensure the right of another consumer to exercise their free speech rights, or exercise another right provided for by law;
· Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 et. seq.);
· Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the information’s deletion may likely render impossible or seriously impair the research’s achievement, if you previously provided informed consent;
· Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us;
· Comply with a legal obligation;
· Make other internal and lawful uses of that information that are compatible with the context in which you provided it.
Exercising Access, Data Portability, and Deletion Rights
To exercise the access, data portability, and deletion rights described in the sections “Access to Specific Information and Data Portability Rights” and “Deletion Request Rights” above, please submit a verifiable consumer request to us at privacy@bathfitter.com, or mail us at 225 Roy Street, Saint-Eustache (Quebec) J7R 5R5, Canada.
Only you, or someone legally authorized to act on your behalf, may make a verifiable consumer request related to your Personal Information. You may also make a verifiable consumer request on behalf of your minor child.
You may only make a verifiable consumer request for access or data portability twice within a twelve (12) month period. The verifiable consumer request must:
· Provide sufficient information that allows us to reasonably verify you are the person about whom we collected Personal Information or an authorized representative;
· Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.
We cannot respond to your request or provide you with Personal Information if we cannot verify your identity or authority to make the request and confirm the Personal Information relates to you.
Making a verifiable consumer request does not require you to create an account with us.
We will only use Personal Information provided in a verifiable consumer request to verify the requestor’s identity or authority to make the request.

Bath Fitter Ltd. requires all third parties to respect the security of your personal data and to treat it in accordance with the law. Bath Fitter Ltd. does not allow its third-party Service Providers to use your personal data for their own purposes and only permit them to process your personal data for specified purposes and in accordance with its instructions.

In case of a data transfer outside the European Economic Area (EEA), such transfer will, where required, take place pursuant to written agreements, which contain provisions (including, but not limited to, European Contractual Clauses) to safeguard your data.
7. DATA SECURITY
Bath Fitter Ltd. has put in place appropriate security measures to prevent your personal data from being accidentally lost, used or accessed in an unauthorised way, altered or disclosed. In addition, Bath Fitter Ltd. limits access to your personal data to those employees, agents, contractors and other third parties who have a business need to know. HOW LONG WILL YOU USE MY PERSONAL DATA FOR?

WHAT WE MAY NEED FROM YOU
Bath Fitter Ltd. may need to request specific information from you to help Bath Fitter Ltd. confirm your identity and ensure your right to access your personal data (or to exercise any of your other rights). This is a security measure to ensure that personal data is not disclosed to any person, who has no right to receive it. Bath Fitter Ltd. may also contact you to ask you for further information in relation to your request to speed up its response.
TIME LIMIT TO RESPOND
Bath Fitter Ltd. tries to respond to all legitimate requests within one month. Occasionally it could take Bath Fitter Ltd. longer than a month if your request is particularly complex or you have made a number of requests. In this case, Bath Fitter Ltd. will notify you and keep you updated.
